Class Action
Jump to section:
Overview
A class action is possible when several individuals who have experienced similar harms join together for a collective action in a court of law. One action is brought on behalf of all members of the class, and all members share in the compensation from the award. Class actions can be comprised of fewer than 100 people and can rise into the thousands.
Some of the claims we have pursued as a class action include:
False and misleading statements about protein content in CytoSport and Muscle Milk products. A $12 million settlement was reached.
Brunswick County charging developers impact fees that exceeded its statutory authority. A $15.25 million settlement was reached.
Premier Protein overstated the amount of protein in its shakes. A $9 million settlement was reached.
Beyond Meat falsely advertised the quality and quantity of protein in several meals. A $7.5 million settlement was reached.
Understanding Class Actions
When several people have suffered a similar harm from a corporation, instead of overwhelming the court with a huge number of lawsuits, the individuals combine their complaints into one lawsuit. This group becomes known as a “class.” The judgment or settlement binds all class members, although the court’s decision can be appealed.
The class action proceeds like a regular lawsuit in front of a judge and jury, with the exchange of information, discoveries, and questioning of witnesses. Formal civil procedures and rules are followed.
Benefits of Class Actions
Lower litigation costs. When efforts are combined into a class action, the cost per individual is reduced. Often, firms will work on a contingency basis, meaning that they are only paid if the court awards compensation.
All class members benefit. Anyone impacted by the harm within the noted timeframe can benefit.
Small harms can be compensated. While one claim on its own may not yield a strong level of compensation, there is strength in numbers. More class members lead to larger awards than what may be obtained individually, which can force change in the corporation.
