State & Local Government Litigation

Jump to section:

Overview

State and local governments have an overarching responsibility to do their best for the public good and manage financial resources in an accountable way. Sometimes situations arise when the actions of corporations negatively impact the public purse, and action must be taken so that the government can continue to be accountable to its ratepayers.

Situations where state and local government may require litigation include:

  • Corporations that pollute or cause environmental degradation, impacting the financial resources and quality of life for all
  • Community supports that are inadequate for success
  • Vendor deals and contractual obligations that are not honored
  • Wrongdoing on the part of corporations that impacts public resources

The resources of government are not unlimited, and being responsible about litigation is incredibly important to achieve an outcome that is beneficial to the electorate.

Current cases by our attorneys in representing state and local government:

  • Aqueous Film-Forming Forms (AFFF) Products Liability Litigation (MDL No. 2873). Representation of municipalities and public water systems to recover costs associated with PFAS forever chemicals in water sources.
  • Insulin Pricing Litigation (MDL No. 3080). Insulin manufacturers and pharmacy benefit managers (PBMs) are artificially inflating the price of insulin at the expense of self-funded health plans and their members and beneficiaries.

The Decision to Pursue Litigation

Understanding when litigation is appropriate is a significant decision for governments, which tend to be risk averse. However, the risk of not pursuing a corporation that is continuing with a destructive or expensive impact also has a risk, and that risk can be multiplied as the negative actions continue.

Governments also want to ensure they set standards by which everyone is expected to operate, including corporate customers. That consistency builds confidence in the public and deters wrongdoings.
