Scott Falgoust is a Partner at Bryson Harris Suciu & DeMay and co-leads the firm’s data breach and data privacy practice. He has represented more than 30,000 clients in mass arbitrations and has worked on data breach class actions involving hundreds of thousands of affected consumers. His work spans state and federal courts and arbitration forums nationwide.

Legal History

Immediately out of law school, Scott joined the litigation team working under one of the 15 attorneys appointed to the Plaintiffs’ Steering Committee in the Deepwater Horizon oil spill multi-district litigation (MDL). He supported discovery and case development, including review and analysis of thousands of documents, coordination with expert witnesses, and trial preparation in one of the largest mass tort proceedings in U.S. history.

Following his three-year commitment on that case, Scott took a leadership role at a firm where he was the main point of contact for a wide range of matters from intake through resolution. He handled cases end-to-end across contract disputes, family law, and succession and estate matters, taking responsibility for strategy, client communication, pleadings, discovery, motion practice, and settlement negotiations. Over the next decade, he developed a practical, client-centered approach grounded in thorough research and a clear assessment of what moves a case forward. He sharpened his ability to evaluate the most effective steps before judges, build a defensible record, and position matters for favorable rulings, negotiated resolution, or trial when necessary.

Throughout this period, Scott remained connected to complex litigation and class actions and was frequently asked to assist other firms on matters where organization, judgment, and speed were critical. He later joined Dan Bryson at Milberg to focus his practice more directly on class action and mass arbitration matters. Drawing on that experience, Scott approaches cases with a litigation-first mindset, developing claims through targeted discovery, motion practice, and evidentiary presentations rather than relying on early settlement pressure alone. He is known for presenting complex factual records in a clear narrative and advocating firmly for plaintiffs while keeping strategy disciplined and evidence-driven.

Many of Scott’s matters resolve on confidential terms, but he is well-regarded by colleagues and co-counsel for his preparation, judgment, and ability to move complex cases efficiently.

At Bryson Harris Suciu DeMay, he helped build the firm’s mass arbitration practice and later took a leading role in expanding the Data Breach and Data Privacy practice, which he co-leads today.

  • Roy v. CNHI, LLC, No. 2:25-cv-00980 (M.D. Ala.): Appointed Co-Lead Counsel in a putative class action arising from unauthorized access to CNHI’s network, in which files containing individuals’ names and Social Security numbers were accessed and taken.
  • In re Delta Dental of Virginia Data Breach Litigation, No. 7:25-cv-00873 (W.D. Va.): Appointed Co-Lead Counsel in litigation arising from the compromise of a company email account, where emails and attachments were accessed without authorization, potentially involving names, Social Security numbers, government-issued ID numbers, and protected health information.
  • In re Oracle Corporation Data Breach Litigation, No. 1:25-cv-01805 (W.D. Tex.): Appointed to the Executive Committee in a proposed class action alleging Oracle failed to implement reasonable data-security measures and timely notification after an incident that allegedly exposed personal information tied to enterprise customers, employees, and contractors.
  • In re WestJet Airlines Data Breach Litigation, No. 3:25-cv-02785 (S.D. Cal.): Appointed to Plaintiffs’ Executive Committee in consolidated litigation arising from a large-scale incident in which consumers allege WestJet failed to adequately safeguard private information, placing class members at heightened risk of identity theft, fraud, and related harms.
  • In re Oil Spill by the Oil Rig “Deepwater Horizon” in the Gulf of Mexico, on April 20, 2010, MDL No. 2179 (E.D. La.): Served on the litigation team for a Plaintiffs’ Steering Committee member, supporting document-intensive discovery, expert witness management, and trial preparation in one of the largest mass tort MDLs in U.S. history.
  • Confidential data breach mass arbitrations (JAMS): Obtained merits findings establishing negligence and breach of contract under multiple state laws, including Michigan, West Virginia, and New Jersey, and proved a violation of the New Jersey Consumer Fraud Act, resulting in treble damages and an award of attorneys’ fees.
  • Confidential privacy and wiretap mass arbitrations (AAA): Established liability under the federal Electronic Communications Privacy Act and the Pennsylvania equivalent (WESCA) based on the use of website tracking technology functioning as a wiretap and transmitting sensitive consumer information to third parties, resulting in awards of statutory damages and attorneys’ fees.
