327,000 Patients Incur Data Privacy Breach at Eye Center

Overview

A class action compliant that Asheville Eye Associates PLLC failed to protect personal information has resulted in a settlement. Asheville Eye was targeted by a cybercriminal group called DragonForce, thought to be connected to Russian or Malaysian governments. The result was a data breach of information for 327,756 patients.

A North Carolina Business Court (Judge Mark A. Davis) has granted preliminary approval of a class action settlement. Included in the settlement agreement is a year of identity theft protection, an attached insurance policy, a voucher for eyeglasses and a financial reimbursement. There is no common fund in the settlement as 100 percent of the class will receive a benefit.

The plaintiffs are represented by two firms including Scott Harris and Michael Dunn of Bryson Harris Suciu DeMay.
