Bryson attorneys are continuing to find success in pursuing a class action against Nestlé for claims related to its Boost Glucose Control nutritional drinks.
The case challenges Nestlé’s use of misleading health claims under federal and state consumer protection laws. The plaintiffs claim that the drink tricks buyers into thinking the beverage can treat diabetes, not only with its packaging, but also, it’s store placement.
The court originally found for Nestlé, but Bryson attorneys were successful on appeal and the lower court ruling was overturned. In May 2025, Nestlé challenged the plaintiffs’ standings in the case, seeking summary judgement. While successful. in removing one of the named plaintiffs, the court denied Nestlé’s request to remove all plaintiffs.
The action is proceeding.
