Attorneys Nick Suciu and Trenton Kashima, along with their co-counsel, reached a $12 million class settlement with Cytosport, Inc. The case explored the overstatement of the amount of protein in their Muscle Milk branded protein shakes, as well as other false or misleading representations regarding the fat contents of the products.

Case Background

Plaintiffs alleged the defendant’s ready-to-drink products contained approximately 10 percent fewer grams of protein than advertised on the label. The products were advertised as “lean” when they actually had significant amounts of added fats.

After years of litigation, and guiding the case through class certification, plaintiffs were able to settle the case on behalf of a national class. During the hearing for final approval, U.S. District Court Judge M. James Lorenz in the Southern District of California praised Messrs. Suciu and Kashima, stating on the record they did a “tremendously effective job” in litigating and resolving the matter on behalf of their clients.
