Attorney Nick Suciu, along with co-counsel, reached a $9 million class settlement with Premier Nutrition Corporation, the makers of Premier Protein Shakes. This was a class action lawsuit claiming that the protein content in the company’s protein shakes is falsely advertised.

Plaintiff Gregorio alleged that, although the shakes are advertised to contain 30 grams of protein, independent testing allegedly showed they contain only between 26.9 and 28.3 grams of protein. The plaintiff further alleges that the other products in the Premier Protein line, like protein bars, also contain less protein than advertised.

The Outcome

After successfully navigating the defendant’s motion to dismiss, the parties were able to enter into a class settlement agreement which provided over 245,000 class members cash payments in the range of approximately $17 to $34 a piece.
